Landybitz LTD PTY Terms & Conditions
General
The Company namely Landybitz AU Suppliers of parts & accessories for Land Rover vehicles.
These are the Company terms & conditions of sale to which all sales including E-Commerce and distance selling is subject. It is the customer responsibility to read the T&C’s on each occasion a purchase is required. All available stock items will normally be dispatched within 48hrs of receiving your order. Any items not in stock can normally be sourced within 24hrs, this does not included delivery times which can be 7/14 working days for UK supplied parts, we will not however be held responsible for delivery times that are subject to our carriers schedules. However if we are unable to supply your request we will inform you of this as soon as possible for Australia supplied stock. A full refund will be given if payment has already been made for the goods. Part numbers and pictures are used for reference only and may not depict the actual product received.
Title & Risk.
Risk of any products shall pass to the buyer or their appointed agent upon receipt of delivery. The title of the goods shall pass to the buyer upon cleared payment in full of the invoice price including delivery costs, until such time the title and ownership of the goods remain with the company. The Company shall be entitled at any time to recover any or all products in the buyers possession to which the Company have title, and for that purpose the Company it’s employees or agents may with such transport as is necessary enter upon any premises occupied by the buyer or any third party or to which the buyer has access and where the goods may be or are believed to be situated.
Prices - All prices are in AU $ and subject to GST at the current rate of 10% on all items. For E-commerce ordering there is a currency changer in the shopping cart. The Company shall not liable for any delay or failure to deliver goods or otherwise perform any obligation as specified in these T&C’s if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control. Prices listed or quoted are based upon costs prevailing at the time when posted on the website or communicated verbally as agreed. The company shall be entitled to adjust the price of the goods as at the time of dispatch and or provision by such amount as may be necessary to cover any increase sustained by the company after the date of acceptance of the buyers order and any direct or indirect costs of making, obtaining, handling storing or supplying the goods. Any such adjustment shall be given will be given in writing by the company to the buyer prior to despatch of the goods. Any quotations are valid for 10 days and subject to conditions.
E-Commerce - GST will automatically be calculated before you submit your order when you go to the checkout page on our secure server. The Company will confirm receipt of your order using the address you supplied when registering on our website. This email is only an acknowledgement and does not constitute legal acceptance by us of your order. Telephone or in person - GST will be given to you verbally and added onto your final invoice along with any agreed carriage costs. Payment - All goods must be paid for in full in AU$ before them or any vehicles or other objects upon which services have been performed are released to the buyer.
Sea Freight - Orders placed that are due to arrive via sea freight, Ie Special orders or longer lead time orders maybe subject to further onshore costs at arrival point. Examples of these but not limited to are, port delays, custom inspection delays, extended container storage, extended container hire, these are the charges that you maybe subjected to if our cargo is delayed beyond our control. These charges normally start 2 weeks after goods arrival and have a average daily charge of $350, raising to $500 per day. Other charges that maybe applicable included further Bio-Security measures, and any other such charge that the port facility see fit to charge. Any such charges will be added to your final invoice. Your goods will not be delivered until full payment is made. Cancellation of sea freight orders will result in a 35% restocking fee, sea order deposits made by Bank/Credit Card/PayPal resulting in Chargebacks to Landybitz will also incur a 35% restocking fee, unless Landybitz have not undertaken reasonable duty in the delivery of said freight. This excludes delayed travel time due to vessel availability, acts of war, On going conflicts, new conflicts at sailing time, future COVID Variant/Pandemic/Bio Weapon/AI Intervention/Act of God/Weather.
Delivery of Goods
General – Under normal circumstances available stock items will be dispatched within 48hrs, Same day for express requests (excluding weekends) of receiving your order under normal staffing operation. Any non- stocked items can normally be sourced within 48hrs (excluding weekends) If we are unable to supply your request we will inform you of this as soon as possible. A full refund will be given if payment has already been made for the goods. Unless otherwise stated the buyer is solely responsible for the cost of delivery, where applicable this will be shown separately on the invoice. E-Commerce - Various delivery options including costs is on our website and can be product specific. If unsure please speak to an advisor. Telephone or in person - Various delivery options including costs will be offered. Unless otherwise stated all carriage costs to be paid by the customer. Any shortages, or non-delivery or damage of goods ordered, the buyer needs to inform the Company within 3 working days. Items listed in stock, should be taken as in stock with Landybitz, In stock with anyone of our Australian/UK suppliers. In stock items form our UK suppliers and or Landybitz UK will have a standard 7/14 days lead time, this does not included delays with customs/air freight that are beyond our control.
Insurance of goods sent from Landybitz and or its 3rd party suppliers is not included in the purchase price unless other wise stated. A option to included insurance with a order is available at check out, at check out you also have to agree to our terms and conditions, Acceptance of a order with no insurance taken is your authority for Landybitz to send your goods with no insurance, said goods that my be lost or damaged by the couriers concerned will not be replaced or refunded, Landybitz in this case will not accept any liability for loss or damage of goods unless insurance was taken at the point of order. Note Glass can not be insured. Goods that have lead times indicated are just that and all lead time are subject to change by the supplier/manufacture Landybitz dissolves all responsibility for such delays when said goods have not even been manufactured be that in Australia or ROW. Goods can also be delayed by future COVID Variant/Pandemic/Bio Weapon/AI Intervention/Act of God/War having impact on global shipping. Goods as of 2023/24 are also affected by the current global supply chain situation, and the continued crisis in the Ukraine And Middle East. And finally is you see a price that looks too good to be true then it more likely will be. This could be a $1000 item listed for $10, due to a simple error with listing. We are not robots and as such we may make a one off listing error, as such you will be refund for the amount paid.
All imported goods are subject to Australia Quarantine inspection, this also includes items that are special order and either in our FCL or LCL. Used parts and vehicles that we supply or ship on your behalf maybe subjected to cleaning costs and other Bio Security measures, these are not included in your invoice costs, and generally will be noted in the customer comments section of your invoice. We retain the right to seek Dunage costs from you based upon the percentage of cargo you may have in the shipment. We also retain the right to charge storage costs of the container due to delays outside of our control.
Warranty - General
Parts warranty & Liability - All new products are covered by a 12 month manufactures warranty unless otherwise stated. You must notify us immediately if a potential warranty situation arises. We will then advise a course of action. Any suspected faulty product must be returned to us together with the original invoice or proof of purchase and with as much information relating to the problem as possible. Any defective parts must be returned and received by us before it can be exchanged. All warranty items are subject to a physical inspection that may involve returning the item to our supplier to verify the fault before it can be exchanged or refunded. If sais supplier is based outside of Australia then this process can take up to 6 months. The warranty commences from the original invoice date and not the date of fitment or first use. The warranty covers defects to the item when fitted and used correctly for normal everyday use but does not apply to items used for any extraordinary or unusual uses such as competition, racing, rallying or items subsequently stripped down, altered, modified or adapted etc. in any way than their original design or intend use., our warranty only covers the product in question and not for any consequential loss or cost, e.g. garage labour, recovery, car hire, re-delivery, parking fines etc. No claim will be validated if misuse neglect, overheating, incorrect installation or failure of a related component causes the failure. Upon acceptance of any warranty item it will be either repaired or replaced free of charge and will only benefit from the balance of the original warranty. Subject to a replacement not being available a full refund will be given.
Returns - General
Returns Policy - For any goods to be returned please contact our customer service team info@landybitz.com.au stating you have a return product where you will be given advice and or instruction on delivery or collection of the product. Please ensure all goods are suitably packed to avoid any breakages during transit to our premises. Any warranty products will be collected free of charge. Before returning any items to the Company, regardless of when purchased, the buyer must obtain a returns note number in advance from the Company and this must accompany the returned item(s).
Exchange unit - A serviceable exchange unit must be suitable for reconditioning; broken or incomplete units will not be accepted.
Faulty Goods - Please notify Landybitz upon identifying a possible fault with the product we will verify the warranty and arrange return of the item to enable our warranty process to begin. (See above for detail)
Unwanted Goods/cancellation* - If you decide you do not want any goods that we have supplied you can return the item(s) within 14 working days commencing the day after the product was received by you the customer. The product must be returned in its original undamaged retail packaging and accompanied by the original invoice. The customer is responsible for the cost of returning the product. Upon receiving and confirming the above the Company will give a full refund no later than 60 days, following the date of receipt of the goods by the Company including the original delivery cost except where the product was part of a consignment. A handling/restocking charge of 35% may be deducted for any items not required and returned.
We retain the right to send you a alternate product, of the same quality or better regardless of its value. If you don’t want the same quality product we ask you to destroy it and revive a full refund.
All special order items are non- returnable. Refunds can take up to 60 days to process. They maybe a Restocking fee of 35% on orders that are cancelled because of a change of mind.
Legal
These conditions and the contract shall be governed by and construed and interpreted in accordance with Australian law and for the purpose of settlement of any disputes arising out of in connection with them the parties will submit themselves to the jurisdiction of the Australia courts.
Acceptance of good(s) shall signify your acceptance and to be bound by the Company’s latest Terms and Conditions.
